By accessing or using our website at https://occreatorai.com/ (the "Site"), you agree to be bound by these Terms and Conditions (the "Terms"). These Terms govern your use of the Site and the Service provided by OC Creator AI ("we," "us," or "our").
OC Creator AI is an independent product and is not affiliated with, endorsed by, or sponsored by OpenAI. GPT Image 2 is the name of a third-party model used by the Service and does not imply any partnership or affiliation with OpenAI.
Please read these Terms carefully before using the Service. If you do not agree with any part of these Terms, you must not use the Site or the Service.

Service Scope
OC Creator AI provides AI-assisted character profiles, world settings, character art, and Design Draft generation. You can edit generated results, save characters to your account, and export character content as JSON or MD files.
Character records are private by default and accessible only to the account owner. The Service does not provide a public Gallery or public sharing. Subscribers may upload their own style reference images for personal generation use, subject to the AI Content & Copyright Policy.
AI Model Disclosure
Our character generation service currently uses GPT Image 2 as the underlying image model. Requests may be routed through third-party infrastructure providers for delivery and failover, but the disclosed model for the service is GPT Image 2.
Inputs and Third-Party Services
Prompts, character descriptions, and generation task data that you submit are used to provide, store, maintain, and securely operate the Service. To provide generation, storage, sign-in, email verification, and payment functions, relevant data may be processed by third-party AI, infrastructure, identity, email, or payment providers. We do not use prompts, generated results, or character data submitted to the Service to train AI models. Do not submit confidential information, trade secrets, or unnecessary sensitive personal information to the Service.
Eligibility
To use our Service, you must be at least 18 years old or have reached the age of majority in your jurisdiction. By using the Service, you represent and warrant that you meet this eligibility requirement. If you are using the Service on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.
Account Registration
To access certain features of the Service, you may be required to create an account. You agree to provide accurate, complete, and up-to-date information during the registration process and to update such information as necessary. You are responsible for safeguarding your account credentials and for any activities or actions under your account, whether authorized or not. You must notify us immediately if you suspect any unauthorized use of your account.
Use of the Service
Permitted Use
OC Creator AI grants you a limited, non-exclusive, non-transferable, and revocable license to use the Service for applicable purposes, subject to these Terms. You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms.
Prohibited Conduct
You agree not to:
- Use the Service to generate or distribute any content that is illegal, harmful, abusive, defamatory, obscene, or otherwise objectionable.
- Attempt to reverse engineer, decompile, or disassemble any part of the Service.
- Use any automated system, including bots, spiders, or scrapers, to access the Site or the Service.
- Engage in any activity that interferes with or disrupts the Service or the servers and networks connected to the Service.
- Use the Service to infringe upon the intellectual property rights of others.
- Submit prompts or requests to generate characters based on real persons without their explicit consent.
- Create, request, or distribute deepfakes, face-swaps, or impersonation content involving real people.
Acceptable Use Policy
You must use the Service in a lawful and responsible manner. The following are strictly prohibited:
- Adult sexual content, explicit nudity, sexual exploitation, or any NSFW content.
- Child sexual abuse material, child exploitation, or any content that endangers minors.
- Violent, hateful, harassing, or discriminatory content.
- Terrorist, extremist, or illegal activity facilitation.
- Deepfakes, face-swaps, impersonation, or deceptive synthetic media involving real persons.
- Generating characters based on real people without their explicit permission.
- Using existing commercial intellectual properties (such as anime characters, game characters, or other copyrighted characters) for commercial purposes without authorization from the copyright holder.
User Content
Ownership and Responsibility
You retain the rights you have in text, character descriptions, and other inputs that you lawfully submit to the Service. Rights in Generated Content depend on applicable law, your inputs, and the rules of relevant third-party services. You are responsible for the content you submit, create, publish, or share through the Service.
License to OC Creator AI
By submitting User Content to the Service, you grant OC Creator AI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, and display such User Content only as necessary to provide, operate, secure, moderate, and support the Service, process your requested outputs, comply with legal obligations, and enforce these Terms.
Content Restrictions
You agree not to submit, generate, or share any User Content that:
- Is misleading, false, or inaccurate.
- Violates any applicable laws or regulations.
- Depicts or promotes pornography, excessive violence, terrorism, extremist activities, or sensitive political content.
- Involves deepfakes, face-swaps, impersonation, or deceptive synthetic media involving real people.
- Infringes on the intellectual property rights of others, including but not limited to trademarks, copyrights, and likeness rights. If you use existing commercial IPs (such as anime or game characters) as references, you must obtain proper authorization from the copyright holder for any commercial use.
- Includes any unsolicited promotions or solicitations.
- Shares personal details of others without their explicit consent.
- Could endanger or exploit children by exposing them to inappropriate content.
- Contains any form of malware, viruses, or other harmful code.
- Is deemed, in our sole judgment, inappropriate or disruptive to other users' experience, or poses potential harm or liability to us or others.
To ensure a safe environment, OC Creator AI employs systems to detect and restrict prohibited content. We reserve the right to take appropriate actions against any Account or User Content involved in illegal production or policy violations, including content removal and account termination.

Commercial IP and Copyright Notice
Third-Party Intellectual Property
OC Creator AI is a tool for generating original character designs. If you choose to create characters inspired by or referencing existing commercial intellectual properties (such as characters from anime, games, movies, or other media), you acknowledge that:
- The underlying intellectual property rights of any referenced commercial characters remain with their respective copyright holders.
- For any commercial use of generated content that references or is based on existing commercial IPs, you must obtain proper authorization and licensing from the relevant copyright holders.
- OC Creator AI does not grant you any license or rights to use third-party intellectual properties for commercial purposes.
- You bear full responsibility for ensuring your use of generated content complies with applicable copyright and intellectual property laws.

Original Creations
Subject to these Terms, applicable law, and the rules of relevant third-party services, you may use character profiles, world settings, character art, and Design Drafts generated through the Service for personal or commercial creative work, including copying, editing, publishing, distributing, and creating derivative works.
AI-generated content may resemble other content. We do not guarantee that any output has independent copyright protection, is eligible for copyright registration, is accurate, or does not infringe third-party rights. You are responsible for the lawful use of your prompts, existing characters, trademarks, real-person information, and other materials.
Content Public Visibility
Our Service allows you to generate character designs ("Generated Content") from the text descriptions and prompts you submit ("User Submissions"). By default, your Generated Content is private and only accessible to you.
The Service will not automatically publish your characters to the homepage, a Gallery, or advertising materials merely because you use the generator. Files you download are no longer subject to the Service's storage practices.
If we introduce public sharing features in the future, any files or content you choose to make public will be governed by additional terms at that time.
Intellectual Property
Ownership of OC Creator AI Content
All intellectual property rights in the Site, the Service, and any content provided by OC Creator AI, including but not limited to software, text, graphics, logos, and trademarks, are owned by OC Creator AI or its licensors. You are granted no rights or licenses in these materials except as expressly stated in these Terms.

User Feedback
Any feedback, suggestions, or ideas you provide to OC Creator AI regarding the Service ("Feedback") will be the exclusive property of OC Creator AI. You hereby assign all rights in the Feedback to OC Creator AI and agree that OC Creator AI is free to use such Feedback without any compensation to you.
Payment and Subscription
Fees
Certain features of the Service may require payment of fees. You agree to pay all applicable fees associated with your use of the Service. OC Creator AI reserves the right to change its fees and billing methods at any time upon notice to you.
Billing
Payments for the Service are processed by one or more third-party payment providers shown at checkout. By providing payment information, you authorize the applicable payment provider and us (as applicable) to charge your selected payment method for the amount shown at checkout, including applicable taxes and fees. Payment providers may vary based on the Service configuration and transaction.
Refunds
Refunds may be granted for billing errors, unauthorized charges, technical failures that prevent delivery of paid core features, non-delivery of a purchased subscription or credits, or where required by applicable law. Delivered add-on credits are generally non-refundable except in those cases. Subscription credits and credits affected by failed generations are assessed based on the current product rules, order status, and actual service delivery.
To request a refund, email support@occreatorai.com with your account email, order number or transaction ID, purchase date, reason for the request, and any supporting evidence. Approved refunds are sent to the original payment method; the time for funds to post depends on the payment provider and card issuer.
Cancel Subscription
You can cancel your subscription at any time via your account's subscription settings. After cancellation, your service will remain active until the end of your current billing cycle. No further charges will be applied.
Cancellation requests should be submitted before the next billing date to avoid renewal for the next period. Cancellation does not automatically create a prorated refund; refund eligibility is governed by these refund rules and applicable law.
Credit System
Credits
The Service operates on a credit-based system. Different generation actions consume different amounts of credits. The applicable costs, validity periods, and plan benefits are shown on the current Pricing page and in your account. Credits are non-transferable; treatment of credits for failed generations or undelivered services is governed by the current Service rules and the refund rules in these Terms.
Termination
Termination by You
You may stop using the Service at any time. To request deletion of your account or related data, contact us at support@occreatorai.com. Requests will be handled based on operational circumstances, billing and security needs, and applicable law.
Termination by OC Creator AI
OC Creator AI may terminate or suspend your account or access to the Service, with or without notice, for any reason, including but not limited to your violation of these Terms.
Effect of Termination
Upon termination, all licenses granted to you under these Terms will immediately terminate, and you must cease all use of the Service. Any accrued rights or obligations will survive termination, including those related to payment and intellectual property.
Disclaimers and Limitation of Liability
Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without any warranties of any kind, whether express, implied, or statutory. OC Creator AI does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, OC Creator AI disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.
AI-generated images may not always meet your expectations. We do not guarantee specific quality or accuracy of generated images.
Limitation of Liability
To the maximum extent permitted by law, OC Creator AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory, even if OC Creator AI has been advised of the possibility of such damages.
Indemnification
You agree to indemnify, defend, and hold harmless OC Creator AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region ("Hong Kong"), excluding its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Hong Kong, except where mandatory consumer protection laws provide otherwise.
Changes to Terms
We may update these Terms at any time. Changes are effective upon posting. Continued use constitutes acceptance of the updated terms.
Miscellaneous
Entire Agreement
These Terms constitute the entire agreement between you and OC Creator AI regarding your use of the Service and supersede any prior agreements between you and OC Creator AI.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.
Waiver
The failure of OC Creator AI to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms or any of your rights or obligations under these Terms without the prior written consent of OC Creator AI. OC Creator AI may freely assign these Terms without restriction.
